Terms of Service
These Terms are a binding agreement between you and Asif Iqbal, an individual operating as Hapto ("Hapto", "we", "us"), who operates canva.hapto.club. By creating an account, buying credits, or generating images you agree to them.
1. What Hapto is
Hapto is self-serve software that uses artificial intelligence to compose new images from reference photos you provide. You buy prepaid credits and redeem them to generate images on demand. Hapto is a digital product — access to software — and not a commissioned-art, retouching, or design service performed by a person on your behalf. One credit produces one generated image; a failed generation is automatically refunded to your balance.
Hapto is an independent product and is not affiliated with, endorsed by, or sponsored by Canva. Canva is a trademark of Canva Pty Ltd. References to Canva describe interoperability only.
AI image generation is powered by leading third-party AI models. Hapto is an independent product and is not affiliated with, endorsed by, or sponsored by those model providers, and their names are not used in our product names.
2. Eligibility
You must be at least 18 years old (or the age of legal majority and consent in your jurisdiction, whichever is greater) and able to form a binding contract. You are responsible for your account and for everything done under it.
3. Your content, your rights, and the licence you give us
You keep ownership of the photos you upload (your "Inputs") and you own the images you generate (your "Outputs"), subject to these Terms. You represent and warrant that, for every face or person in your Inputs, you are that person or you have their explicit consent, and that your Inputs do not depict a public figure, celebrity, or any third party without consent, and do not depict a minor. You grant us a limited, worldwide, royalty-free licence to host, process, and transform your Inputs solely to provide the service to you (i.e. to generate your Outputs and deliver them back). We do not sell your Inputs or Outputs, and we do not use your uploaded photos to train any AI model. We retain Inputs only as long as needed to run and support your generation and then delete them on the schedule described in our Privacy Policy.
4. Acceptable use
Your use of Hapto is governed by our Acceptable Use Policy, which prohibits, among other things, uploading images of people without consent, public figures, or minors, and creating sexual, nude, deceptive, defamatory, impersonating, or otherwise unlawful content. Violations may result in immediate suspension or termination and, where required, reporting to the authorities.
In particular, you must not create or upload NSFW, pornographic, adult, or sexually explicit or suggestive content, and you must not attempt to bypass, disable, or obfuscate our content-safety controls (including through coded language or manipulated inputs). To enforce these rules we screen both your prompt and the photos you upload before generating — using automated content-safety systems, including detection of recognizable public figures, apparent minors, and explicit imagery — and we block requests that violate them.
5. AI outputs — important disclaimer
Outputs are generated by AI. They are synthetic, may be inaccurate or unexpected, and must not be presented as authentic, unaltered photographs of real events or as endorsements by any person. Outputs are provided "as is" without warranties of accuracy, likeness fidelity, or fitness for a particular purpose. You are responsible for how you use your Outputs. You may use your Outputs for personal, non-commercial purposes; any commercial use requires our prior written consent.
6. Credits, billing, and the Merchant of Record
Pricing is per app: each app's credit packs and prices are shown on that app's page in your local currency where available. Payments are processed by our authorised Merchant(s) of Record (for example Creem internationally and Razorpay in India), who act as the seller of record for the transaction, handle applicable taxes, and appear on your statement. Credits are added to your balance immediately on successful payment. Credits are tied to your account, are not transferable, and have no cash value. Refunds are governed by our Refund Policy.
7. Suspension and termination
We may suspend or terminate access if you breach these Terms or the Acceptable Use Policy, or to comply with law. You may stop using Hapto at any time.
8. Indemnity
You agree to indemnify and hold Hapto harmless from claims arising out of your Inputs, your Outputs, or your use of the service in breach of these Terms — including any claim that you lacked the rights or consent to use an uploaded photo.
9. Limitation of liability
To the maximum extent permitted by law, Hapto is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.
10. Governing law
These Terms are governed by the laws of India, and disputes are subject to the courts of Kolkata, West Bengal, India.
11. Changes
We may update these Terms; material changes will be reflected by the effective date above. Continued use after a change means you accept it.
